1. Introduction and Acceptance of Terms

Welcome to Peakline ("we," "us," "our," or the "Company"). These Terms of Service ("Terms") govern your access to and use of the Peakline mobile application (the "App" or "Service"), available on iOS and Android platforms.

By downloading, installing, accessing, or using Peakline, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App after any changes indicates your acceptance of the modified Terms. We encourage you to review these Terms periodically.

2. Eligibility and Account Registration

Age Requirements

Peakline is intended for users who are at least 13 years of age. If you are under 18 years old, you represent that you have your parent's or legal guardian's permission to use the App. We do not knowingly collect or solicit personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete that information promptly.

Account Creation

To access certain features of Peakline, you may need to complete an onboarding process and provide information such as:

  • Your name or nickname
  • Your age group
  • Your self-improvement focus areas (e.g., Focus, Strength, Nutrition, Relationships, Spirituality, Time Management)
  • Your experience level with habit tracking
  • Your preferred notification style

You agree to provide accurate, current, and complete information and to keep this information updated. You are solely responsible for maintaining the confidentiality of your device and any activities that occur under your profile.

3. Description of the Service

Peakline is an AI-powered habit tracking and personal development application designed to help you build better daily routines. The Service includes:

  • Habit and Task Management: Create, track, and manage daily habits and tasks organized by time of day (morning, afternoon, evening), with various metric types including duration, distance, count, and binary completion.
  • AI Coaching: Access an AI-powered chat coach that provides personalized feedback, suggestions, and motivation based on your habits and progress.
  • AI Task Suggestions: Receive AI-generated task recommendations tailored to your goals and focus areas.
  • Celebrity Routines: Browse and copy daily routines inspired by successful individuals to use as templates for your own habits.
  • Progress Tracking: View your streak data, completion rates, calendar heatmaps, and personal dimension scores (Focus, Nutrition, Relationships, Spirituality, Strength, Time Management).
  • Customizable Notifications: Set reminders in your preferred style (Standard, Motivational, or playful "Roast" mode).

Peakline is designed to provide structure and motivation for personal habit-building. It is not a substitute for professional medical, psychological, fitness, legal, or financial advice. You should consult qualified professionals before making significant lifestyle changes.

4. User Responsibilities and Acceptable Use

By using Peakline, you agree to:

  • Use the App only for lawful purposes and in accordance with these Terms
  • Provide accurate information about yourself during onboarding and throughout your use of the App
  • Maintain the security of your device and profile
  • Notify us promptly of any unauthorized access to or use of your profile
  • Use the AI features responsibly and not attempt to manipulate or abuse them

Prohibited Conduct

You agree not to:

  • Use the App for any illegal, harmful, or fraudulent purpose
  • Attempt to gain unauthorized access to our systems, servers, or other users' data
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Interfere with or disrupt the integrity or performance of the App or its underlying systems
  • Transmit any viruses, malware, or other harmful code through the App
  • Use automated systems (bots, scrapers, etc.) to access the App without our express permission
  • Attempt to circumvent any security measures or content protection mechanisms
  • Use the App in a manner that could damage, disable, overburden, or impair our servers or networks
  • Impersonate any person or entity, or falsely claim an affiliation with any person or entity
  • Use the AI chat feature to seek professional advice in areas such as medicine, mental health, law, or finance

5. User Content

Your Content

"User Content" refers to any information, data, or content you create, input, or store within Peakline, including but not limited to: habit titles and descriptions, task details, notes, AI chat conversations, and profile information.

You retain ownership of your User Content. By using the App, you grant us a limited, non-exclusive, worldwide, royalty-free license to store, process, and display your User Content solely for the purpose of providing and improving the Service. This license ends when you delete your User Content or your account.

Content Responsibility

You are solely responsible for your User Content. You represent and warrant that you have all rights necessary to grant the licenses described above and that your User Content does not violate any third-party rights or applicable laws.

AI Interactions

When you use our AI coaching features, your messages and relevant context (habits, progress data) are sent to AI service providers to generate responses. We do not guarantee the accuracy, completeness, or suitability of AI-generated content. AI responses are for informational and motivational purposes only and should not be relied upon as professional advice.

6. Subscriptions, Payments, and Billing

Free and Premium Features

Peakline offers both free features and premium features that require a paid subscription ("Peakline Pro" or "Premium").

  • Free Features: Basic habit tracking, task management, and limited access to certain features are available without a subscription.
  • Premium Features: Full access to AI coaching, AI task suggestions, advanced analytics, and other enhanced features require an active Premium subscription.

Subscription Terms

Premium subscriptions are billed through the Apple App Store or Google Play Store (collectively, "App Stores"). By purchasing a subscription:

  • You agree to pay the subscription fee displayed at the time of purchase
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
  • Your App Store account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel your subscription through your App Store account settings
  • Any unused portion of a free trial period will be forfeited when you purchase a subscription

Price Changes

We may change subscription prices at any time. Price changes will take effect at the start of the next subscription period following the date of the price change. We will provide you with reasonable notice of any price changes as required by the App Stores.

7. Free Trials, Refunds, and Cancellations

Free Trials

We may offer free trial periods for Premium features. At the end of the free trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. You can cancel at any time through your App Store account settings.

Refunds

All purchases are final and non-refundable, except as required by applicable law or as otherwise provided by the App Store policies. Refund requests must be directed to Apple (for iOS) or Google (for Android) through their respective support channels.

Cancellation

You may cancel your subscription at any time through your App Store account settings. Upon cancellation:

  • You will retain access to Premium features until the end of your current billing period
  • Your subscription will not renew, and you will not be charged again
  • After the subscription period ends, you will revert to the free tier
  • Your data will not be deleted upon cancellation; you may continue using free features

8. Intellectual Property

Our Intellectual Property

The Peakline App, including all content, features, functionality, design, graphics, logos, icons, images, audio clips, text, software, and code, is owned by us or our licensors and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

The Peakline name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks. You may not use these marks without our prior written permission.

License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, solely for your personal, non-commercial use.

Celebrity Content Disclaimer

The celebrity-inspired routines and profiles featured in Peakline are provided for educational and inspirational purposes only. Celebrity names and information are used to illustrate example routines and habits. We are not affiliated with, endorsed by, or sponsored by any of the celebrities or public figures referenced in the App. All celebrity information is based on publicly available sources and may not represent their actual current routines.

9. Third-Party Services and Links

Peakline integrates with and relies on various third-party services to provide functionality:

  • Firebase Services: We use Google Firebase for analytics, crash reporting, cloud functions, and data storage.
  • RevenueCat: We use RevenueCat to manage subscriptions and in-app purchases.
  • AI Service Providers: We use third-party AI services (such as OpenAI or Anthropic) to power our AI coaching and suggestion features.
  • App Stores: Subscriptions and payments are processed through Apple App Store and Google Play Store.

These third-party services have their own terms of service and privacy policies. We are not responsible for the practices of these third parties. We encourage you to review their policies.

The App may contain links to third-party websites or services. We do not control and are not responsible for the content, privacy policies, or practices of any third-party websites or services.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

  • The App will be available at all times or operate without interruption or errors
  • Defects will be corrected in a timely manner
  • The App or servers are free of viruses or other harmful components
  • The results of using the App will meet your expectations or goals
  • AI-generated suggestions, coaching, or notifications will be accurate, helpful, or appropriate for your situation
  • Following habits or routines (including celebrity-inspired routines) will produce any specific results

Health and Wellness Disclaimer

Peakline is not a medical, psychological, fitness, or healthcare service. The App is designed to help you organize and track personal habits and goals. It is not intended to diagnose, treat, cure, or prevent any disease or health condition.

Always consult with qualified healthcare professionals before starting any new exercise program, diet, or making significant lifestyle changes. Never disregard professional medical advice or delay seeking it because of something you have read or experienced in the App.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • Your access to or use of (or inability to access or use) the App
  • Any conduct or content of any third party on or related to the App
  • Any content obtained from the App, including AI-generated content
  • Unauthorized access, use, or alteration of your content or data
  • Any actions taken or not taken based on AI coaching, suggestions, or notifications
  • Any failure to achieve desired results from following habits, routines, or suggestions

In no event shall our total liability to you for all claims arising out of or relating to these Terms or the App exceed the greater of (a) the amounts you have paid us in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100 USD).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Peakline and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your violation of any third-party right, including any intellectual property, privacy, or proprietary right
  • Your User Content
  • Your use of the App in a manner not authorized by these Terms
  • Any claim that your use of the App caused damage to a third party

13. Termination and Suspension of Accounts

Termination by You

You may stop using the App at any time. You may request deletion of your account and associated data by using the "Delete Account" feature in the App settings or by contacting us at the email address provided below.

Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, with or without cause and with or without notice, for conduct that we believe:

  • Violates these Terms or any applicable law or regulation
  • Is harmful to other users, third parties, or our business interests
  • Involves fraud, abuse, or misuse of the App or its features

Effect of Termination

Upon termination:

  • Your right to use the App will immediately cease
  • We may delete your account and User Content (subject to our data retention policies)
  • Provisions of these Terms that by their nature should survive termination will continue to apply
  • You will not be entitled to any refund of subscription fees already paid

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith informal negotiation. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue formal dispute resolution.

For users in the European Union, you may also be entitled to submit disputes to the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

Nothing in these Terms shall affect any statutory rights that cannot be waived or limited by contract.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Update the "Last updated" date at the top of this document
  • Notify you through the App, via email (if you have provided one), or by other reasonable means
  • Provide you with at least thirty (30) days' notice before material changes take effect, where required by law

Your continued use of the App after any changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the App.

16. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Peakline regarding your use of the App and supersede any prior agreements.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations under these Terms without your consent.
